Terms of Service
The terms that govern your use of VartaAPI.

These Terms of Service (“Terms”) govern your access to and use of VartaAPI (the “Service”), operated by Kavin International (“we”, “us”). By creating an account or using the Service you agree to these Terms.
1. What VartaAPI is
VartaAPI is a platform that connects your business WhatsApp number to the official WhatsApp Business Platform provided by Meta, and lets you send template messages, run campaigns, reply from a shared inbox, automate conversations and manage contacts.
2. Accounts and eligibility
- You must be able to enter a binding contract and be acting for a business, not as a consumer.
- You are responsible for everything that happens under your account, and for keeping your credentials secure.
- You are responsible for the team members you invite and the access level you give them.
3. Your responsibilities
- You must comply with the WhatsApp Business Messaging Policy, Meta’s platform terms and all applicable law.
- You must obtain valid opt-in consent from a contact before messaging them, and honour opt-out requests promptly. The Service records STOP/START automatically, but the obligation is yours.
- You must not send spam, unlawful, misleading, harassing or abusive content.
- You are responsible for the accuracy of the contact data you upload and for having the right to use it.
4. The WhatsApp Business Platform and Meta
Message delivery depends on Meta. Meta may change its rates, policies, template approval rules and rate limits at any time, and may restrict or disable a phone number or WhatsApp Business Account. We are not responsible for those decisions, but we will pass on what we are told.
5. Plans, fees and taxes
- Subscription plans are billed monthly in advance. Prices are shown on our pricing page.
- GST is charged in addition at the applicable rate (currently 18% for SaaS in India).
- We may change plan pricing with reasonable notice. Changes take effect at your next renewal.
6. WhatsApp message charges are billed by Meta
VartaAPI is a Meta Tech Provider. This has a specific meaning for what you pay and to whom.
- Meta bills you directly for the WhatsApp messages you send, against the payment method registered on your own WhatsApp Business Account. Those charges are a contract between you and Meta.
- We do not resell WhatsApp messages and take no margin on them. The subscription in clause 5 is the only sum payable to us for the platform.
- Meta sets and may change its own message rates, by category and destination country. We have no control over them and do not guarantee them.
- Your account carries a wallet used for metered platform features such as the AI assistant, where your plan includes them. Adding funds to the wallet is currently disabled, and WhatsApp message charges are not taken from it.
7. Refunds
Refunds are governed by our Refund Policy, which forms part of these Terms.
8. Your data and your customers’ data
You keep ownership of your account data, your contacts and your message content. We process it to run the Service, as described in our Privacy Policy. In relation to your customers’ personal data you are the data fiduciary and we act as a data processor on your instructions.
9. Acceptable use
You may not use the Service to: break the law; infringe anyone’s rights; send messages to people who have not opted in; attempt to gain unauthorised access to our systems; resell access without our written agreement; or run automated abuse against our API.
10. Availability and support
We work to keep the Service available but do not promise uninterrupted operation. Planned maintenance, third-party outages and Meta platform incidents can all affect availability.
11. Intellectual property
The Service, its software and its branding belong to Kavin International. These Terms do not transfer any of it to you. “WhatsApp” and “Meta” are trademarks of their respective owners; we are an independent provider built on Meta’s public Cloud API and are not endorsed by Meta.
12. Suspension and termination
- You may stop using the Service at any time and cancel your plan from inside the app.
- We may suspend or terminate access if you breach these Terms, breach the WhatsApp policies, or put our Meta account at risk.
- On termination, any unused wallet balance is handled under the Refund Policy. Charges owed to Meta remain a matter between you and Meta.
13. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, to the extent permitted by law. We do not warrant that message delivery, template approval or any commercial outcome will be achieved.
14. Limitation of liability
To the maximum extent permitted by law, Kavin International will not be liable for indirect, incidental, special or consequential loss, or for lost profits, revenue or data. Our total aggregate liability arising out of the Service is limited to the amounts you paid us in the three months before the event giving rise to the claim.
15. Indemnity
You will indemnify us against claims arising from your content, your use of the Service, your breach of these Terms, or your breach of the WhatsApp policies or applicable law.
16. Changes to these Terms
We may update these Terms. We will change the “last updated” date and, for material changes, give notice in the app or by email. Continued use after changes take effect means you accept them.
17. Governing law
These Terms are governed by the laws of India. The courts at Jalandhar, Punjab have exclusive jurisdiction.
